The Carrier is Responsible for Cargo Beyond the Vessel Itself
Until now, the ocean carrier's liability was heavily restricted-in short: they were primarily
responsible for a container while it was physically on board the vessel. The amendment
completely alters this dynamic. Now, the carrier bears full liability for the cargo from the
moment they take custody of it until it is released.
In practice, if your container is damaged while stored at a port terminal in China (before
loading or immediately after discharge), you no longer have to struggle with the port
operator or search for who is at fault. The ocean carrier bears the liability. For Polish
companies, this represents an immense simplification when pursuing compensation for
damaged goods.
The End of Paperwork: Electronic Bills of Lading in the Spotlight
Another milestone is the full legal equalization of electronic bills of lading (eB/L) with
traditional paper documents. This is a massive leap forward. Telex release or sending
physical paperwork across continents via courier can slowly be phased out.
Digital transport documents based on secure systems will drastically accelerate the cargo
release process at ports and streamline the entire logistics cycle.
Environmental Protection and Stricter Penalties for Carriers
The new Chinese Maritime Code also places immense emphasis on ecology and pollution
liability. Extremely rigorous requirements regarding carrier insurance have been
introduced. Interestingly, in the case of environmental incidents, it is now possible to sue
insurers directly before Chinese courts. For the market, this translates to greater stability
and the elimination of unverified, high-risk carriers from the oceans.
